Magistrate may grant bail in bailable cases [s402 CrPC, s7 Bail Act 1997]. The amount of bail shall not be excessive [s11 Bail Act].

Magistrate may grant bail in non bailable cases except where the sentence is death or life imprisonment [s403 CrPC].

Filing of Charges / Institution of Proceedings

Proceedings may be instituted by a written report from an official, written complaint, or warrant of the AGO [s136 CrPC].

Magistrate frames the charge [s182].

Summary Trial

Magistrate tries case if within jurisdiction [s182ff CrPC].

Maximum sentence: 2 years [s14].
