Judgement Enforcement Commentary

The data is sourced from the Department of Judgement Enforcement. Data analysed concentrates on the first six months of 2025, January to end June, as this offers the most detailed data for 2025.

The analysis aims to understand better the blockages that cause a steadily increasing number of outstanding judgements for enforcement. Of this, approximately 80% nationally are accounted for by judgements in relation to matters defined as drugs and criminal matters. Further information would enhance the ability to address the apparently slow enforcement of court judgements, and help to answer questions including:

  • How do insufficient judgement enforcement resources affect the implementation of judgements?
  • How does the incarceration of people subject to judgement enforcement affect the large proportion of unenforced criminal and drug related judgements?
  • How does the financial situation of people subject to judgement enforcement affect the limited enforcement of judgements, particularly in relation to criminal and drug related judgements?

Greater disaggregation of data collected by Judgement Enforcement would help to analyse the issue of delay and plan strategies. The following categories of disaggregated data are proposed.

In relation to all cases

  • Gender of the person subject to judgement enforcement

Civil cases

  • Value of the case, in Kip
  • Completed or enforced cases by voluntary enforcement
  • Completed or enforced cases by mandatory enforcement
  • Completed or enforced cases waived by the creditor
  • Outstanding cases where the person is outside Lao PDR
  • Outstanding cases under Art. 43 - insufficient property or income to pay
  • Outstanding suspended cases

Criminal / Drugs cases

  • Level of seriousness of case - minor or very serious
  • Whether the person subject to judgement enforcement is incarcerated
  • Whether the person subject to judgement enforcement is outside Lao PDR
  • Art. 43 - insufficient property or income to pay
  • Suspended
